Briefings Coupang dispute enters treaty terrain as investors trigger arbitration clockISDS notice formalizes a regulatory clash Seoul had sought to contain while narrowing diplomatic room for maneuver U.S. investors in Coupang have notified the South Korean government of their intent to pursue investor-state dispute settlement (ISDS) arbitration, arguing that Seoul’s handling of the company’s personal data breach violated protections under the Korea-U.S. free trade agreement, the justice ministry said Thursday. The investors, Greenoaks and Altimeter, claimed that a sweeping government response following the breach last December breached obligations related to fair and equitable treatment and other investor protections, triggering losses running into the billions of dollars. Under ISDS procedures, a formal arbitration process may be initiated 90 days after the submission of a notice of intent. The © Korea Risk Group. All rights reserved. |
