Court cites procedural errors in detention, triggering security fears and partisan battles ahead of impeachment ruling
The Seoul Central District Court on Friday overturned President Yoon Suk-yeol’s detention, ruling that he had been indicted after his custody period had expired. The court determined that procedural errors, including miscalculations in detention time, rendered his continued imprisonment unlawful. It also questioned the legality of the Corruption Investigation Office for High-ranking Officials’ involvement in the case, citing concerns over jurisdiction.
Despite the ruling, Yoon remains in custody as prosecutors consider an appeal. Under South Korean law, they have seven days to challenge the decision. The court’s ruling does not affect Yoon’s impeachment trial before the Constitutional Court, which is expected to decide his fate some time next week.
