The Constitutional Court\u2019s impending ruling on President Yoon Seok-yeol\u2019s impeachment, expected as early as this week, could plunge South Korea into a political and constitutional crisis if Yoon refuses to accept the verdict.<\/span><\/p>\n

Political tensions have escalated following Yoon\u2019s release from prison on March 8, with growing concerns that the president and his supporters could reject the court\u2019s decision and trigger a constitutional crisis.<\/span><\/p>\n

The high-stakes ruling comes amid warnings from legal experts that defying the court\u2019s decision could undermine South Korea\u2019s democratic norms and deepen societal divisions.<\/span><\/p>\n

POLITICAL UNCERTAINTY<\/b><\/p>\n

Former conservative lawmaker Yoo Seung-min has <\/span>criticized<\/span><\/a> Yoon\u2019s behavior following his release, arguing that the president has shown little contrition and has not made a clear commitment to accepting the Constitutional Court\u2019s verdict.<\/span><\/p>\n

For instance, instead of offering a contrite message to voters for his arrest, Yoon met with senior members of the ruling People Power Party (PPP) and his senior staff in the presidential residence, asking them to continue to uphold state affairs. The move appeared to indicate that he was returning to office even though he remains suspended until the court issues a ruling.<\/span><\/p>\n

The suspended president also reportedly told Presidential Office staffers that he has had the chance to \u201clearn a lot\u201d from his time in prison, stating that he had \u201cdiligently read the bible.\u201d<\/span><\/p>\n

Political analysts Rhee Jong-hoon of Politics and Business Consulting and Jang Yong-geun, a professor at Hongik University, told <\/span>Korea Pro<\/span><\/i> they believe Yoon is unlikely to accept the court\u2019s verdict should it uphold his impeachment.<\/span><\/p>\n

Myongji University\u2019s political science professor Shin Yul echoed those concerns, adding, \u201cNot accepting the decision \u2026 would be unthinkable.\u201d<\/span><\/p>\n

Shin noted that while most trials have an appeals process, the impeachment trial is being overseen by the country\u2019s highest court, meaning Yoon is at the end of the road. He warned that outright refusal to accept the Constitutional Court\u2019s decision would be seen as \u201cdenying the Constitution\u201d in the eyes of the public.<\/span><\/p>\n

Even so, Yoon\u2019s attorney, Seok Dong-hyun, <\/span>asserted<\/span><\/a> on Feb. 19 that there was \u201cno scenario\u201d in which Yoon would reject the decision. However, Seok has undermined the public\u2019s confidence in his assurance by frequently asserting that the impeachment proceedings are unconstitutional and illegal.<\/span><\/p>\n

Moreover, the PPP has also <\/span>undermined<\/span><\/a> the court\u2019s authority. For instance, former party leader Kim Gi-hyeon argued that the impeachment hearings were invalid, citing the main opposition Democratic Party\u2019s (DP) decision to remove sedition charges from its original impeachment motion.<\/span><\/p>\n

Cho Jin-man, a political science professor at Duksung Women\u2019s University, noted that tensions will likely remain high as the president continues his legal battles, with conservatives blaming the opposition for the crisis.<\/span><\/p>\n

\u201cWhile psychological and political resistance to defeat is natural, accepting unfavorable rulings is a fundamental principle of democracy. The responsibility to ease societal conflicts lies with political leaders, yet current rhetoric appears to exacerbate divisions rather than foster reconciliation,\u201d Cho said.<\/span><\/p>\n

Cho also pointed to the lack of a clear commitment from Yoon to respect the court\u2019s decision as a growing concern.<\/span><\/p>\n

\u201cHistorical precedents show that even in closely contested elections, democratic norms require eventual acceptance. If political leaders fail to provide stabilizing messages, South Korea could enter an even more intense period of conflict,\u201d he said.<\/span><\/p>\n

POTENTIAL FOR VIOLENCE<\/b><\/p>\n

As South Koreans await the Constitutional Court\u2019s ruling, public and institutional anxiety is mounting over the possibility of violent unrest. For instance, Ahn Cheol-soo \u2014 one of the few PPP lawmakers who publicly voted to impeach Yoon for his martial law declaration \u2014 warned that failure to respect the court\u2019s verdict could result in a civil conflict.<\/span><\/p>\n

Rhee and Shin expressed similar concerns, recalling the 2017 protests following the impeachment of President Park Geun-hye, when four of Park\u2019s supporters <\/span>died<\/span><\/a> after violent clashes with police.<\/span><\/p>\n

Authorities have already intensified security measures to prevent unrest. Acting President Choi Sang-mok vowed on Tuesday that while the government would respect citizens\u2019 right to free speech, it would have a zero-tolerance policy toward any types of violence and would prosecute provocateurs to the fullest extent of the law.<\/span><\/p>\n

The Seoul Metropolitan Police also <\/span>announced<\/span><\/a> plans to deploy all available personnel and equipment to the court to ensure that violence does not occur. The police also stated that they would designate areas around the court as a \u201c<\/span>special crime prevention zone<\/span><\/a>.\u201d<\/span><\/p>\n

Law enforcement appear to be reacting to Yoon\u2019s supporters following his release from prison. The day Yoon was released from custody, Jeon Gwang-hoon, an evangelical pastor and a fierce Yoon supporter, held a <\/span>rally<\/span><\/a> around the presidential residence where he declared to 5,000 people that Yoon\u2019s release rendered the impeachment trial \u201cmeaningless.\u201d<\/span><\/p>\n

Meanwhile, opposition politicians and activists have held daily protests and some went on hunger strike to demand that the court uphold Yoon\u2019s impeachment. Following Yoon\u2019s release, the DP <\/span>staged<\/span><\/a> overnight sit-ins at the National Assembly\u2019s Rotunda Hall while other opposition groups set up protest tents in Seoul\u2019s Gwanghwamun Square.<\/span><\/p>\n

CONSTITUTIONAL INTEGRITY AT STAKE<\/b><\/p>\n

Political and religious leaders have <\/span>called<\/span><\/a> for national unity and respect for the court\u2019s decision, regardless of the outcome. Park Byung-seok, a former National Assembly speaker, urged parliament to pass a resolution pledging to respect the court\u2019s ruling. Meanwhile, leaders from seven major religious groups released a joint statement emphasizing the need to respect democratic principles.<\/span><\/p>\n

Cho of Duksung Women\u2019s University noted that ultimately, the country\u2019s political trajectory will depend on how the ruling party and opposition respond after the ruling. \u201cThe general public, despite political tensions, is likely to accept the court\u2019s decision,\u201d he said.<\/span><\/p>\n

If Yoon\u2019s impeachment is upheld, the acting president must schedule a presidential election within 10 days and hold it within 60 days, as mandated by the Constitution and the Public Official Election Act.<\/span><\/p>\n

However, concerns have emerged over Acting President Choi\u2019s commitment to constitutional procedures following his refusal to appoint Constitutional Court judge nominee Ma Eun-hyuk to the bench despite the court declaring his inaction \u201c<\/span>unconstitutional<\/span><\/a>.\u201d<\/span><\/p>\n

POLITICAL AFTERMATH<\/b><\/p>\n

The Constitutional Court\u2019s ruling on Yoon\u2019s impeachment represents a critical test for South Korea\u2019s democratic institutions. While security measures have been strengthened to prevent unrest, the political response from Yoon, his supporters and opposition parties will ultimately shape the country\u2019s future.<\/span><\/p>\n

Whether Yoon accepts the ruling or challenges it, South Korea faces a volatile political period that could determine the stability of its democratic norms.<\/span><\/p>\n
