President Yoon Suk-yeol was released from detention after prosecutors chose not to appeal a <\/span>court ruling<\/span><\/a> that declared his initial arrest unlawful. Yoon, who was indicted on insurrection charges following his failed martial law bid in December, walked free on Saturday after the court ruled that the prosecution had filed the indictment after the detention period had already expired. Prosecutors had the option to appeal under South Korea\u2019s <\/span>Criminal Procedure Act<\/span><\/a> but declined to pursue it.<\/span><\/p>\n The main opposition Democratic Party (DP) <\/span>accused<\/span><\/a> the prosecution of mishandling the case and demanded Prosecutor General Shim Woo-jung\u2019s resignation. DP floor leader Park Chan-dae said Shim \u201cvoluntarily gave up the opportunity to appeal\u201d and warned that the party would push for Shim\u2019s impeachment if he refuses to resign. The DP and four minor opposition parties also <\/span>announced<\/span><\/a> plans to file a complaint against Shim with the Corruption Investigation Office for High-ranking Officials. The ruling People Power Party (PPP) <\/span>defended<\/span><\/a> the prosecution\u2019s decision, arguing that the court\u2019s ruling confirmed that Yoon\u2019s arrest had been legally flawed.<\/span><\/p>\n WHY IT MATTERS<\/b><\/p>\n The prosecution\u2019s decision not to appeal Yoon\u2019s release could reflect strategic caution. An appeal that failed on procedural grounds could have undermined both the criminal trial and the impeachment process, which would have allowed Yoon to claim political vindication. By avoiding a procedural battle, the prosecution may be focusing on strengthening its substantive case against the impeached president. A procedural misstep that led to Yoon\u2019s reinstatement would devastate the prosecution\u2019s credibility.<\/span><\/p>\n The DP\u2019s threat to impeach Shim likely reflects the opposition\u2019s growing confidence following its recent <\/span>political resurgence<\/span><\/a>. Recent polling shows the DP regaining ground, with Gallup Korea putting the party at 40% compared to 36% for the PPP. Support for Yoon\u2019s removal remains at around 60%, with centrist voters especially backing impeachment. If the DP successfully forces Shim out, it could strengthen its credibility and consolidate its position ahead of future elections. But failure to impeach Shim could backfire, fueling perceptions that the opposition is overreaching.<\/span><\/p>\n
