South Korea\u2019s Supreme Court <\/span>ruled<\/span><\/a> on July 18 that denying health insurance coverage to same-sex spouses constitutes discrimination based on sexual orientation, affirming a lower court\u2019s <\/span>Feb. 2023<\/span><\/a> decision. However, the LGBTQ+ community continues to face pervasive discrimination and legislative inaction in their fight for equal rights.<\/span><\/p>\n

The court stated that denying those benefits to same-sex couples, even without specific provisions for same-sex unions in the country\u2019s <\/span>National Health Insurance Act<\/span><\/a>, \u201cviolates the constitutional principle of equality and infringes on human dignity and the right to equality before the law.\u201d<\/span><\/p>\n

The National Health Insurance Service (NHIS) <\/span>stated<\/span><\/a> that it would respect the Supreme Court\u2019s decision and examine how to implement the ruling. Concurrently, the <\/span>National Human Rights Commission of Korea<\/span><\/a> welcomed the ruling and called for further legal reforms to ensure equal rights and protections for LGBTQ+ individuals.<\/span><\/p>\n

South Korea\u2019s LGBTQ+ community rejoiced and welcomed the decision, seeing it as a hopeful step toward legalizing same-sex marriage in the country. However, members of the queer community stressed the importance of sustained public advocacy and engagement to achieve meaningful advancements in LGBTQ+ rights.<\/span><\/p>\n

LANDMARK VICTORY<\/b><\/p>\n

LGBTQ rights activists in South Korea hailed the Supreme Court\u2019s ruling as a landmark victory, offering a platform for further advocacy and legislative change toward full equality.<\/span><\/p>\n

So Sung-uk and his partner Kim Yong-min, the gay couple whose 2021 lawsuit against the NHIS led to the ruling, <\/span>expressed<\/span><\/a> their elation at a press conference, declaring, \u201cLove has won.\u201d<\/span><\/p>\n

Horim Yi, an activist with Marriage for All Korea, characterized the recognition of same-sex spouses as groundbreaking, hoping it would \u201cgalvanize efforts to legalize same-sex marriage and spur increased engagement from political, media, and civil society sectors in championing LGBTQ+ rights.\u201d<\/span><\/p>\n

\u201cThe legal rights we have obtained for the first time in 30 years are historic and very meaningful, and I personally feel very excited and pleased,\u201d Shim Ki-yong, an activist with Chingusai, a Korean gay men\u2019s rights group, said.<\/span><\/p>\n

Kim Beom-soo, 35, an openly gay South Korean citizen, expressed his surprise at the ruling, viewing it as a significant and progressive step in an otherwise conservative society.\u00a0<\/span><\/p>\n

\u201cIt would be beneficial to have open discussions and debates about these issues. Our current tendency to avoid addressing non-traditional perspectives is seen as a virtue, but I hope that this recent ruling will lead to more discussions and a move toward a more open society,\u201d he said.<\/span><\/p>\n

CALLS FOR COMPREHENSIVE REFORMS<\/b><\/p>\n

Keumgae, a queer activist and podcaster, celebrated the ruling\u2019s explicit acknowledgment of discrimination based on sexual orientation. However, she cautioned against focusing solely on the issue of marriage equality, emphasizing the importance of broader anti-discrimination protections and support for marginalized LGBTQ+ individuals facing poverty and mental health issues.<\/span><\/p>\n

Yi of Marriage for All Korea highlighted the ruling\u2019s broader implications, calling for legislative and executive action to establish full equality for same-sex couples in South Korea, which lags behind other Asian countries in recognizing LGBTQ+ rights.<\/span><\/p>\n

Kim agreed, noting that \u201cinternational solidarity can be a lifeline for those facing hate and discrimination here.\u201d<\/span><\/p>\n

Shim stressed the need for further progress, including legalizing same-sex marriage and comprehensive anti-discrimination laws and ensuring LGBTQ+ rights in various social and legal arenas, including education.<\/span><\/p>\n

\u201cAlthough learning from global human rights trends is valuable, South Korea’s unique socio-political context requires ongoing advocacy and engagement from civil society to effect meaningful change,\u201d Shim said.\u00a0<\/span><\/p>\n

PERSISTENT OPPOSITION<\/b><\/p>\n

Despite the ruling, anti-LGBTQ+ sentiments remain pervasive in South Korea. The United Christian Churches of Korea (UCCK) and the Korea Church Law Association issued a <\/span>joint statement<\/span><\/a> following the court\u2019s ruling, opposing it on Biblical teachings and traditional grounds.<\/span><\/p>\n

They warned that the decision \u201cwill negatively impact the sentiments and social order of Korean society.\u201d<\/span><\/p>\n

Activist Horim Yi countered that the ROK is a secular and democratic state and that the ruling reflects the country\u2019s constitutional guarantee of equal rights and freedoms for all.<\/span><\/p>\n

The UCCK did not respond to <\/span>Korea Pro\u2019s<\/span><\/i> inquiries regarding the joint statement.\u00a0<\/span><\/p>\n

Conservative Christian groups have frequently opposed LGBTQ+ rights, often <\/span>voicing<\/span><\/a> their objections at queer parades and rallies. On <\/span>July 18<\/span><\/a>, these groups protested outside the Supreme Court building, holding banners that declared, \u201cSame-sex families are nonsense.\u201d<\/span><\/p>\n

A <\/span>2022<\/span><\/a> study by the Korean Society of Law and Policy on Sexual Orientation and Gender Identity highlighted the persistence of anti-LGBTQ+ sentiment and hate speech in South Korea.<\/span><\/p>\n

For instance, the Seoul Metropolitan Government faced criticism in 2023 for <\/span>denying<\/span><\/a> the Seoul Queer Culture Festival permission to use a plaza in front of City Hall, instead granting the space to the evangelical Christian Television Service for a youth concert on the same day.<\/span><\/p>\n

Shim Ki-yong of Chingusai argued that conservative Christian groups often interpret equality issues through a religious lens and that secular states should not treat such views as rational or democratic.<\/span><\/p>\n

Kim Beom-soo shared that his devout Christian upbringing initially conflicted with his sexual identity. However, he highlighted diverse perspectives within Christianity, noting that \u201cthe conservative stance of many Korean churches does not necessarily reflect all Christians.\u201d<\/span><\/p>\n

Queer activist Keumgae expressed confusion over anti-LGBTQ+ groups\u2019 intense focus on the community, suggesting they might find more fulfilling activities. She noted that humor has become a coping mechanism within the LGBTQ+ community in response to such opposition.\u00a0<\/span><\/p>\n

\u201cI hope hate groups and Christian organizations can embrace a spirit of tolerance and love,\u201d she said.<\/span><\/p>\n

POLITICS LAGS BEHIND\u00a0<\/b><\/p>\n

The Supreme Court’s decision highlighted the gap between growing public support for same-sex marriage and the lack of political action in South Korea. Activists call for more decisive action from politicians to address the absence of comprehensive anti-discrimination laws.\u00a0<\/span><\/p>\n

Shim of Chingusai criticized the country\u2019s political leaders, noting that they often \u201cavoid legislating for minority rights due to a perceived lack of consensus and influence from certain religious groups.\u201d<\/span><\/p>\n

Yi of Marriage for All Korea pointed out that a <\/span>2023 Gallup Korea survey<\/span><\/a> revealed that 40% of Koreans favor legalizing same-sex marriage and urged politicians to heed this rising support.<\/span><\/p>\n

Queer activist Keumgae emphasized that South Korean politics should not be overly influenced by religious groups when addressing this issue, stating it should be approached \u201cfrom the perspective of basic human rights.\u201d She urged the majority opposition Democratic Party to actively pursue equality for South Korea\u2019s minorities.<\/span><\/p>\n

Kim Beom-soo recalled the promises that progressive politicians made to pass an anti-discrimination law during the 2016 Seoul Queer Parade \u2014 promises that went unfulfilled.\u00a0<\/span><\/p>\n

\u201cI believe they have grossly neglected their duties, and I worry that the significance of recent Supreme Court rulings might be diminished due to this neglect,\u201d Kim asserted, criticizing the continued delay in legislative action.<\/span><\/p>\n

Then-Justice Party lawmaker Jang Hye-young\u2019s <\/span>proposed<\/span><\/a> Marriage Equality Act in May 2023 aimed to legally recognize same-sex marriages and received <\/span>bipartisan support<\/span><\/a>. However, despite Jang\u2019s efforts, neither that bill nor her <\/span>proposed anti-discrimination bill<\/span><\/a> passed before the end of her term.<\/span><\/p>\n

Those bills\u2019 prospects grew more grim when the Justice Party failed to secure any seats in April\u2019s parliamentary elections.<\/span><\/p>\n

Cho Jin-man, a political science professor at Duksung Women\u2019s University, emphasized that South Korea still lags behind Western democracies in protecting the rights of minorities. However, he pointed out that the country\u2019s political polarization often makes this process slow.\u00a0<\/span><\/p>\n

\u201cIt is up to the legislative and executive branches to determine how to effectively implement these decisions,\u201d Cho told <\/span>Korea Pro<\/span><\/i>.<\/span><\/p>\n
