Opposition party lawmakers have been <\/span>calling<\/span><\/a> for Justice Minister Han Dong-hoon to resign since the Constitutional Court upheld a pair of controversial reform laws on Thursday that the previous administration passed. The Moon Jae-in administration and the Democratic Party (DP) <\/span>passed amendments<\/span><\/a> to the Criminal Procedure Act and the Prosecutors\u2019 Office Act to reduce prosecutors’ authority to investigate crimes. The types of crimes they could investigate were reduced from six to two \u2014 corruption and economic crimes.\u00a0<\/span><\/p>\n Han and a group of prosecutors <\/span>filed a joint petition<\/span><\/a> with the Constitutional Court in June, asking that the court void the laws. They claimed the laws violated the prosecutors\u2019 right to investigate and prosecute. Two PPP lawmakers filed a separate complaint with the court over the legislative procedure by which the bills were passed. The court dismissed Han\u2019s petition.<\/span><\/p>\n Han, a former prosecutor himself, <\/span>announced<\/span><\/a> a revision of a presidential decree in August to expand prosecutors\u2019 investigative powers. Opposition lawmakers have since demanded Han\u2019s resignation or impeachment for trying to block the prosecution reforms laws. Han told the parliamentary judiciary committee that he would stand by the enforcement decree to recover prosecutors\u2019 investigative rights.<\/span><\/p>\n Why It Matters<\/b><\/p>\n Han has expressed disagreement with the Constitutional Court\u2019s ruling. He took issue with the justices upholding the law even though they agreed that there were irregularities with its passage. The PPP <\/span>accused<\/span><\/a> the DP of deliberately having one of its lawmakers leave the party and declare himself an independent lawmaker to help the DP to pass the laws. Han said it was difficult to agree with the court\u2019s decision to uphold the laws even though it agreed that there were legal violations involved in the passage of the laws. Han will likely use that as justification to continue to expand prosecutors\u2019 investigative powers.<\/span><\/p>\n It is also likely that opposition lawmakers have been demanding Han\u2019s resignation because they <\/span>see him<\/span><\/a> as a possible threat and contender in the next presidential election. A <\/span>Gallup Korea poll<\/span><\/a> from earlier this month found that among the likely conservative candidates who will run for president in 2027, Justice Minister Han Dong-hoon had the highest favorability rate (30%).<\/span><\/p>\n
