On Feb. 4, led by its leader Lee Jae-myung, 100 lawmakers and approximately 25,000 supporters of the main opposition Democratic Party (DP) held a <\/span>massive anti-government rally<\/span><\/a> in central Seoul. It was the first time the DP had organized such a rally in six years when it demanded then-President Park Geun-hye\u2019s impeachment.<\/span><\/p>\n

Surrounded by throngs of supporters carrying blue balloons <\/span>\u2014 the DP\u2019s color \u2014 Lee Jae-myung <\/span>criticized<\/span><\/a> the Yoon administration\u2019s attempt to \u201csilence the opposition\u201d by way of \u201cprosecutorial tyranny,\u201d all the while \u201cneglecting the people\u2019s basic needs.\u201d<\/span><\/p>\n

Lee used the event as a show of force to warn President Yoon Suk-yeol that he wouldn\u2019t be an easy mark. Lee is currently under <\/span>investigation<\/span><\/a> over corruption allegations surrounding a massive development project pushed for in Seongnam city while he was the city\u2019s mayor. But looks can be deceiving, and Lee may be in a weaker position than he appears.<\/span><\/p>\n

DEEPENING LEGAL WOES<\/b><\/p>\n

Prosecutors <\/span>accuse<\/span><\/a> Lee of receiving millions of dollars in the form of corporate sponsorships to the Seongnam Football Club (FC). In exchange for these corporate sponsorships, prosecutors allege that Lee used his authority as mayor to provide unfair advantages to these organizations.\u00a0<\/span><\/p>\n

In a separate case, prosecutors also suspect Lee was involved in what has commonly come to be known as <\/span>the Daejang-dong land development scandal<\/span><\/a>.\u00a0<\/span><\/p>\n

The scandal centers on allegations that an obscure and small private asset management company, Hwacheon Daeyu, and its affiliates reaped exponential profits during Lee\u2019s time as Seongnam\u2019s mayor when a close aide to Lee allegedly <\/span>leaked<\/span><\/a> inside information to real estate developers, helping them make nearly 21 billion won.\u00a0<\/span><\/p>\n

Prosecutors allege that the aide did so in exchange for financial kickbacks, which were then allegedly used to <\/span>fund<\/span><\/a> Lee Jae-myung\u2019s ultimately unsuccessful presidential campaign.<\/span><\/p>\n

Although Lee denies all allegations against him, the prosecution has already made the unprecedented move to summon him \u2014 an incumbent opposition leader \u2014 for questioning. Twice. And they will likely summon him <\/span>a third time<\/span><\/a>.<\/span><\/p>\n

Lee\u2019s legal woes took a turn for the worse in late January when <\/span>Kim Seong-tae<\/span><\/a>, the former chairperson of Ssangbangwool Group, a fugitive businessman with ties to Lee Jae-myung allegedly told prosecutors that he <\/span>delivered<\/span><\/a> $8 million to North Korea in 2019.\u00a0<\/span><\/p>\n

Kim Seong-tae alleged that of the $8 million, $5 million was to fund inter-Korean projects, and $3 million was to facilitate then-Gyeonggi Governor Lee Jae-myung\u2019s visit to North Korea. Any such transference of money to North Korea would have been illegal.<\/span><\/p>\n

Lee again rejected all allegations against him, claiming the investigation was \u201cpolitically motivated.\u201d<\/span><\/p>\n

However, sensing that the prosecution seemed intent on arresting him, Lee <\/span>said<\/span><\/a> during a press conference that he would be indicted. However, he framed any prosecution he might face as a political attack by saying, \u201cI\u2019m paying the price for losing the presidential election.\u201d<\/span><\/p>\n

LEGAL, NOT POLITICAL, IMMUNITY<\/b><\/p>\n

However, it is doubtful that Lee Jae-myung will be detained. Article 44, Section 1 of the <\/span>ROK Constitution<\/span><\/a> states, \u201cDuring the sessions of the National Assembly, no member of the National Assembly shall be arrested or detained without the consent of the National Assembly except in case of flagrante delicto.\u201d<\/span><\/p>\n

As the DP has a majority in the National Assembly, it can veto any attempt by the prosecution to arrest Lee. The difficulty of indicting, much less arresting, an incumbent lawmaker was made apparent in December when the National Assembly <\/span>voted against<\/span><\/a> a motion to allow the arrest of a four-term DP lawmaker, Rep. Noh Woong-rae, whom prosecutors accused of bribery.<\/span><\/p>\n

Arresting Lee Jae-myung is much more improbable. When he won the <\/span>June by-election<\/span><\/a> to represent part of Incheon <\/span>\u2014 a district he had no links to previously \u2014<\/span> and became a National Assembly representative, political <\/span>opponents<\/span><\/a> and <\/span>observers<\/span><\/a> speculated that he did so purely to attain legal immunity. As criminal allegations against him continue to mount, such views are unlikely to dissipate.<\/span><\/p>\n

Although Lee Jae-myung may appear safely ensconced in his party position, the massive anti-government rally he led over the weekend suggests he may not have the full support of the DP. It is telling that only 100 DP lawmakers were at his side when there are 168 DP lawmakers in parliament.<\/span><\/p>\n

Although he might not be facing open challenges to his leadership, the 68 lawmakers\u2019 apparent lack of enthusiasm hints that Lee Jae-myung might not command the loyalty of everyone within his party.<\/span><\/p>\n

DP floor leader Park Hong-keun appeared to share this lack of confidence when he <\/span>said<\/span><\/a> during a closed-door party conference on Jan. 31, \u201cThe motion to indict Chairman Lee Jae-myung will go through a free vote. As we don\u2019t know how the results will turn out, the party leadership should do a good job (of cracking down on votes).\u201d<\/span><\/p>\n

There seems to be a reason for this apparent lack of cohesion around Lee Jae-myung: <\/span>polls<\/span><\/a> show that Lee is increasingly a political burden for his party.<\/span><\/p>\n

Other <\/span>polls<\/span><\/a> indicate that the investigation into Lee Jae-myung is seen as \u201cjustified\u201d by some 50% of the public, while 40% see it as an act of political retaliation.<\/span><\/p>\n

HEAVY MILLSTONE<\/b><\/p>\n

From President Yoon Suk-yeol\u2019s point of view, sustained prosecutorial pressure on Lee is probably good news for him and the conservatives, especially <\/span>given the breadth and seriousness of the allegations against the DP leader. The DP\u2019s approval rate is <\/span>29%<\/span><\/a>, while the ruling People Power Party\u2019s (PPP) approval rating is 36%.<\/span><\/p>\n

Even if the prosecution fails to arrest Lee, they could indict him and force him to appear in court. And the trial against him will last for months or even years, which will suit Yoon just fine as he has his eyes set on next year\u2019s parliamentary elections and <\/span>seeks to boost<\/span><\/a> his low approval rating.<\/span><\/p>\n

Although the <\/span>PPP\u2019s leadership race<\/span><\/a> shows that the conservatives are not united, DP lawmakers should be worried. Lee Jae-myung\u2019s legal woes are not good news for them and could cause the DP to split.<\/span><\/p>\n
